Holbrook, J.. This is an appeal by plaintiffs from the grant of a motion for summary judgment in favor of defendant-appellee, The Benton Harbor Neys Palladium.

In June, 1968, defendant Marion Cobb began delivering “The Benton Harbor News Palladium”, a newspaper published by appellee. Defendant Cobb was designated as a “Motor Route Carrier” in the written lease agreement entered into by Cobb and appellee newspaper.
