MARTIN, Circuit Judge.

The appeals in these two cases are from the same United States District Court and involve the same points, so one opinion will be adequate.

The petitions filed by appellants sought restitution to them as owners of slot machines alleged to have been wrongfully seized by agents of the United States under “pretended authority” of the Johnson Act, 15 U.S.C.A. §§ 1171 to 1177. In the Rice case, the appellant was not arrested or indicted for violation of the Johnson Act, or of any other statute; but, in the Puckett case, a warrant for the defendant’s arrest was executed.…
