I. INTRODUCTION
On September 18, 2008, plaintiff Rufus Davis (“plaintiff’) filed this action against defendant National Railroad Passenger Corporation (“Amtrak”). Plaintiff alleges employment discrimination based on race and disability, as well as retaliation in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., as amended by the Civil Rights Act of 1991, 42 U.S.C. § 1981a (“Title VII”), the Americans with Disabilities Act, 42 U.S.C. § 12101 et seq.
