This is an action to recover for the value of a jennet, run over and killed by a freight train of the defendant, which was begun before a justice of the peace, and judgment rendered for the plaintiff, and appealed to the county court, where the case was tried to the court without a jury, which resulted in favor of the plaintiff in the sum of $100, from which the railroad com pany appeals and alleges error. The court made findings of fact and conclusions of law as follows:
