Appellees petitioned for the construction of a public drain under section turn of the act of March 11, 1907 (Acts 1907 p. 508, §6141 Burns 1908). The matter was duly referred to the drainage commissioners, who made and filed their report therein on July 15, 1908. In this report it ivas found that the proposed drain was practicable, tliat its construction would improve the public *136health, benefit certain highways, be of public utility, that it would be sufficient to drain properly the lands affected thereby, that appellant’s land would be benefited and should be assessed therefor in the sum of…
