This is a suit to require the heirs of one Antone Joseph, deceased, to specifically perform a certain contract alleged to have been entered into between plaintiff and the said Joseph, whereby Joseph agreed to make and execute a will devising and bequeathing all his property at the date of his death to the plaintiff, to the exclusion of his other heirs at law. The deceased was a Portuguese, formerly from the Island of Pico, who settled in Josephine County some years prior to 1874.
