Action in the district court for Blue Earth county to recover $2,000 for the conversion of certain hotel furniture and fixtures. The answer was a general denial. The case was tried before Pfau, J., and a jury which returned a verdict in favor of plaintiff for $758.33. From an order denying defendant’s motion for judgment notwithstanding the verdict or for a new trial, he appealed.

Defendant was the owner of a hotel building in Mankato, this state, fully equipped with all necessary furniture and fixtures, and on July 18, 1906, he leased the building to one Town for the term of five years. As a part of the same transaction, and at the same *77time, lie sold to Town all the hotel furniture and 'fixtures for $1,500, a part of which was then paid. Town executed to defendant his three promissory notes of equal amounts for the balance of the purchase price, and to secure the payment of the same a chattel mortgage upon the hotel furniture, fixtures, and furnishings.
