ORDER GRANTING DEFENDANTS’ MOTIONS TO DISMISS

Before the Court are the Motions to Dismiss filed by all Defendants on July 30 and August 19, 2009. (See Dkt. Nos. 38, 42, 45.) Defendants generally argue that Plaintiff Rebecca Ryan has failed to show that the Court should excuse her failure to make demand on the board of Nominal Defendant Regions Morgan Keegan MultiSector Fund 1 (the “Fund”) before filing this derivative suit.
