MEMORANDUM OPINION

This matter is before the Court on cross-motions for summary judgment. Plaintiff Dahlia Khodra (hereinafter "Khodra") renewed her motion for summary judgment1 and defendant Mark L. Milligan (hereinafter "Milligan") filed an opposition and cross-motion.
