This case is before us on remand from the United States Supreme Court. James Koste filed the present action in the United States District Court 2 for the Eastern District of Missouri seeking a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. The district court denied Koste’s petition, see Koste v. Dormire, No. 4:98CV1709 (E.D.Mo.
