MEMORANDUM AND ORDER ON DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT AND PLAINTIFF’S CROSS-MOTION FOR SUMMARY JUDGMENT

The plaintiff, Bradley Marehant, brought suit alleging violations of the Fair Debt Collection Practice Act [FDCPA], 15 U.S.C. §§ 1692-1692o. The defendants, U.S. Collections West, Inc., and Dorothy Darnell, moved for summary judgment on two issues. The plaintiff responded to that motion and made a cross-motion for summary judgment.
