This is an action upon a note and book account for groceries purchased by a group of young men associated together and known as members of the Pi Kappa Alpha Fraternity at the Kansas State College of Agriculture and Applied Science, at Manhattan, Kan. Forty-six members of the fraternity were made *382defendants as partners, operating under the name of the Pi Kappa Alpha Fraternity, and the funds of the fraternity were garnisheed in a bank in Manhattan.
