MEMORANDUM OPINION

The matters currently before the Court are a motion for summary judgment by Respondent Gary Bangs, the Director, Industry Operations of the Baltimore Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives (hereinafter “ATF”), with the U.S. Department of Justice, see Doc. No. 13, and a motion for leave to file a surreply by Petitioner Charles Gilbert (“Gilbert”), see Doc. No. 29.
