MEMORANDUM OPINION

MYRON H. THOMPSON, Chief Judge.

This litigation arises from a lawsuit filed in 1981 alleging that the State of Alabama’s teacher certification test impermissibly discriminated against African-American persons seeking teacher certification. On May 14, 1987, the court approved and entered a consent decree providing for the development of a new test. On August 28, 1995, defendants filed a motion to modify the consent decree, and on September 25, 1995, defendants filed an alternative motion to vacate the consent decree.
