Miguel Ortiz was convicted of rape, aggravated sodomy, incest, and battery against the victim, his 15-year-old niece. Ortiz enumerates six errors.

The victim lived with Ortiz, his wife and three children, two of Ortiz’s brothers and her mother. As she accompanied Ortiz on some errands, Ortiz detoured, turned off on a rural road and stopped. While on this isolated dirt road, Ortiz beat, raped, and sodomized his young niece.
