Defendant appeals as of right from a circuit court order granting plaintiff summary disposition on its construction bond claim. We affirm.

The facts in this case are not in dispute. Granger Construction Company was the primary con-

*71tractor on a project involving the construction of the Genesee County jail. As required by the Michigan public works bond act, MCL 129.201 et seq.; MSA 5.2321(1) et seq., Granger furnished a payment bond, issued by defendant as surety, for the protection of certain claimants supplying labor or materials for the project.
