Class Plaintiffs consist of twelve persons who obtained certification of a class in their action against Debtor Tom Livaditis (“Debtor”) in the District Court for the Northern District of Illinois (the “District Court”). Class Plaintiffs have now moved for certification of the same class in this bankruptcy case pursuant to Fed.R.Civ.P. 23 (“Rule 23”) and Bankruptcy Rules 7023 and 9014.
