This action was commenced by John P. Merritt, hereinafter referred to as plaintiff, to recover $3,075 damages from the Oklahoma Natural Gas Company, defendant. The trial coúrt sustained a demurrer to the petition of plaintiff and entered judgment for the defendant. The plaintiff has- filed his. petition in error with transcript attached and assigns as the sole error the action of the trial court in sustaining the demurrer to the petition.
