The Court has before it the parties’ cross-motions for summary judgment, as well as memoranda and affidavits filed in connection with their motions. The Court has also had the benefit of oral argument with respect to these motions.

Plaintiff Concrete General, Inc., a Maryland corporation engaged in the business of highway construction, brings this action to challenge the constitutionality of the Minority Procurement Policy (“MPP”), adopted by the Washington Suburban Sanitary Commission with regard to procurement contracts.
