OPINION

FUTEY, Judge.

Plaintiff, an air traffic controller and former member of the Professional Air Traffic Controller’s Organization seeks to recover monies deducted from his paycheck by the Federal Aviation Administration from August 3, 1981 to October 22, 1981, while the union engaged in an illegal strike in which plaintiff did not participate. Plaintiff requests that this court grant certification to a class comprising those air traffic controllers who did not strike.
