Petitioner, a civil service employe of the State of California, seeks mandate to compel allowance of sick leave with pay for three days, July 18, 19, and 20, 1945, when he was necessarily absent from his regularly assigned duties in the Department of Finance in order to care for his critically ill wife. He had at the time of such absence accumulated to his credit 59 days of unused sick leave. He duly filed with the Department of Finance his request for sick leave with pay.
