This declaratory judgment action was brought by Rockingham Mutual Insurance Company (hereinafter “Rockingham Mutual”) requesting a declaration from the Court that they do not have a duty to defend nor to indemnify the defendant, Carroll Shifflett, under a homeowner’s insurance policy that Rockingham Mutual had issued to Shifflett and which was in full force and effect on February 14, 1998.
