I. INTRODUCTION
Appellant The Heil Company (“Heil”) challenges the trial court’s order denying its motion for summary judgment and granting summary judgment in favor of appellees Polar Corporation, as the surviving entity of a merger between Pentron, Inc. (“Pentron”) and Polar (“Polar”), and Richard L. Frank (“Frank”). In three issues, Heil complains that the trial court erred by denying its motion for summary judgment, by granting Polar’s motion for summary judgment, and by overruling its objections to part of Polar’s summary judgment evidence.
