On March 21, 1921, during the noon hour, Alice Kaplan, six years nine months of age, while playing with a rope on the side*111walk in front of her residence, No. 176 East One Hundred and First street, borough of Manhattan, was run over and injured by a delivery automobile in charge of Charles Hery who was employed by defendant and was serving defendant’s customers with bread on Lexington avenue between One Hundred and One Hundred and First streets.
