I. BACKGROUND

This case has a complex procedural history. The plaintiff commenced this action by filing a complaint on May 31, 2007, claiming failure to pay overtime wages to the plaintiff and similarly situated loan officers employed by the defendants in accordance with the Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 201, et seq.
