The defendant previously moved, inter alia, for the suppression of statements he allegedly made in this matter. Pursuant to the order of Judge Francis D. Ricigliano, this motion was granted to the extent of ordering a hearing be held to determine whether the subject statements were obtained involuntarily within the meaning of CPL 60.45 (2) (b) (ii). Judge Ricigliano specifically excluded the issue of probable cause from the hearing.
