This is an application for a writ of habeas corpus on behalf of Marion Frank Crawford, a state prisoner, now confined under a sentence of death imposed upon his conviction of murder in the first degree.

*701Petitioner was indicted by the Grand Jury at the January 7,1963, Term of the Superior Court of Forsyth County, North Carolina, for the crime of murder in the first degree and, in a separate indictment, for the crime of rape.
