MAXWELL, Chief Judge.

Petitioner is presently serving a fifteen year sentence in the West Virginia State Penitentiary following his conviction for armed robbery in the Intermediate Court of Kanawha County. Petitioner seeks federal habeas corpus in this Court, assailing his state court con*873viction. The prayer of his petition was earlier denied and subsequently appealed. This matter is again before this Court on remand from the United States Court of Appeals for the Fourth Circuit.
