REID, Senior Judge:

After a bench trial, appellant, Jarrell A. Gayden, was convicted of assault on a police officer (APO), and attempted threats.1 For the reasons stated below, we affirm in part and reverse in part.

FACTUAL SUMMARY

The government presented the testimony of MPD Officer Arthur Kimball who stated that he was conducting his regular patrol on August 28, 2012, in the 4400 block of Ponds Street in the Northeast quadrant of the District of Columbia, when he saw Mr. Gayden standing in the alley between Ponds and Quarles Streets.
