Snyder, Judge:

Action brought December 24, 1880, in the circuit court of Cabell county by John W. Downey against the Chesapeake and Ohio Railway Company to recover damages for injuries received by the plaintiff through the alleged negligence of the defendant. On June 24, 1881, there was a verdict in favor of the plaintiff for $5,000.00, on which the court entered judgment. The defendant demurred to each count of the declaration, which demurrer the court overruled.
