In October, 1923, plaintiffs made a written agreement with defendant to sell him a piece of real estate in Summerhill Borough, Cambria County, to which they had derived title by inheritance from Elizabeth Myers, who died the preceding June. The consideration was $3,000, of which $500 was paid in cash and the balance, for which this suit was brought, was payable on delivery of a proper deed.
