This action in trespass was brought by a.minor and her parents to recover compensation for injuries sustained by her when she was struck by an automobile owned and operated by the defendant. Plaintiffs’ evidence was that the child, then eight years of age, was walking across a street between crossings, in plain view, and that when she was about three-fourths of the way across the twenty-six-foot cartway she was struck by defendant, who had approached the place of the accident at a speed of 40 to 45 miles an hour without sounding a warning.
