This case presents error from the district court of Cherokee county. It is an action brought by the plaintiff in error against the Tahlequah Water Company and the town of Tahlequah, for the purpose of recovering damages. The facts out of which the action arose are substantially as follows: The Crystal Springs Water Company had secured a. franchise to install a system of waterworks for the town of Tahlequah and as a part of its franchise it was required to supply the town with water to extinguish fires, in consideration of which it was to receive hydrant rental of $50 for each hydrant…
