Kay Fritz filed a pro se complaint against Michael Shadwich, David Stoner, SS Properties Group, LLC, Best Land Investments, LLC, and John C. Whitmire Construction (collectively “Appellees”), seeking damages related to an allegedly wrongful eviction from her home. Appellees filed a motion to dismiss the suit for failure to state a claim upon which relief could be granted on the grounds that Fritz’s claim was barred by res judicata and collateral estoppel given previous lawsuits related to a foreclosure and dispossessory action evicting Fritz from the residence.
