Plaintiff is a duly licensed physician in the state of Ohio. Upon completion of his residency in psychiatry in 1979, he was appointed to the unclassified position of psychiatrist at the Toledo Mental Health Center in Toledo, Ohio.

On May 26, 1982, plaintiff received written notice from John P. Rogers, the Superintendent of the Toledo Mental Health Center, that revocation of his appointment was being considered due to charges of sexual harassment by a female employee.
