Tammy Crocker brings this permissive, interlocutory appeal from the entry of summary judgment in a medical malpractice lawsuit against Thomas Babcock, IV, M.D. (Babcock), Longview Emergency Medicine Associates, Inc. (LEMA), and Good Shepherd Medical Center (Good Shepherd). The trial court found that Babcock, LEMA, and Good Shepherd were entitled to the benefit of the heightened standard of proof in cases involving emergency medical care as set forth in Section 74.153 of the Texas Civil Practice and Remedies Code.
