In this case the plaintiff seeks to recover damages for personal injuries sustained by him in the city of Billings, on December 24, 1923, by reason of falling through an open elevator shaft maintained by the defendants in a building which was occupied by them. By his complaint he alleges both general and special damages aggregating $23,158.67. On issue joined, the case was tried to a jury, which returned a general verdict in plaintiff’s favor, assessing his damages at $6,158.67, upon which judgment was duly entered.
