MEMORANDUM OF FINDINGS AND CONCLUSIONS

LEIGHTON, District Judge.

I. Introduction

This is a civil action brought against the United States of America under the Federal Tort Claims Act, 28 U.S.C. § 2671 et seq. Plaintiff, Pearl Davis, sues in her capacity as executrix of the estate of her deceased husband, Raymond E. Davis.
