This is a controversy over the proceeds of seventy-seven bales of cotton, shipped by one Blake-more from his plantation in Arkansas to the defendants, Hill, Fontaine & Co., cotton factors in Memphis, in this State, to be sold on his account. This cotton, at the time of its shipment, was covered by a trust deed, made by the consignor for the purpose of securing the complainant in the payment of a debt, the larger part of which remains unpaid.
