The appellant was indicted in the circuit court of Lee county under chapter 171, Laws of 1914 (Hemingway’s Code, sections 1093-1095, inclusive), for the rape of Ltacy Duncan, a female over twelve, and under eighteen years of age. From that judgment he appeals.

Appellant assigns as error the giving of the following-instruction for the state:
