Leander Bester, the appellant, was jointly indicted with Georgia Lee Fowler, at the April 1954 Term of the Circuit Court of Pearl River County on a charge of lar*709ceny of 67 sacks of tnng nuts of the value of 80 cents per sack, and of the total value of $53.60, the personal property of W. M. McGuire. The case was tried at the April 1954 Term of the court, and the appellant was convicted and sentenced to imprisonment in the state penitentiary for a term of four years. From that judgment he prosecutes this appeal.
