In this action plaintiff seeks recovery upon a contract of insurance against accidental death, and recovery of penalties and attorneys’ fees for vexatious refusal to pay pursuant to Missouri’s penalty statute Section 375.420, RSMo. The claim is that the insured suffered an accidental mortal gunshot wound. Under governing Missouri law the primary defense must be based on alleged suicide while sane.
