On November 30, 1973, the district court granted the defendant’s motion for summary judgment. On November 18, 1974, the circuit court affirmed the decision of the district court. The plaintiff now appeals by leave granted.

In an earlier suit, the defendant obtained a default judgment against the plaintiff for the balance due on a note that the plaintiff had co-signed. As a judgment creditor, the defendant then got a writ of garnishment, which it served on the plaintiff’s bank, the garnishee defendant of the earlier action.
