I. The Facts and Peoceedings

Defendant, Charles Snow, requested and received a jury trial on charges of escaping from the State Prison of Southern Michigan. The jury found him guilty. He was sentenced to a term of two to five years.

On appeal, Snow raised three issues in the Court of Appeals. The first two were that the trial court abused its discretion by allowing additional witnesses to be endorsed at trial and that, after such indorsement, the defense should have been granted a continuance.
