This suit was filed in the circuit court of Saline county, by the Bituminous Casualty Corporation, appellant, who will be referred to hereinafter, as plaintiff, against the City of Harrisburg, a municipal corporation, operating under the commission form of government, appellee, who will be referred to hereinafter as defendant.
