This case arises out of a bicycle accident which occurred on a newly widened section of a road in the City of Port Collins (City). The parents of fifteen-year-old Timothy Swieckowski (Swieckowski) brought this action for personal injuries he suffered. Swieckowski rode his bicycle against the flow of traffic on a newly widened section of road and tumbled head first into a ditch running perpendicular to the road.
