The defendant resided with his father and a married brother on.a farm "adjacent to the town of Thayer, in Union'County, Iowa. ' On the 8th day of March, 1926, one Col-lings, the sheriff of Union County, accompanied by one Bourke, drove in 'an 'automobile to the home of the appellant, for the purpose of serving certain papers upon the appellant which related to the condemnation of certain land. .
