This is an action in ejectment.

Plaintiff Ralph Jenning claims title to and right of immediate possession of the real property in controversy as beneficiary under the last will and testament of Bernace A. Jenning.

The defendant Mamie I. Jenning claims title to and the right of immediate possession of the same real property as beneficiary under the will of Fred 0. Jenning.
