JONES, Justice.

Jimmy Leach was charged with the third-degree felony offense of possession of a controlled substance, to-wit, amphetamine, in an amount of one gram or more but less than four grams. See Tex.Health & Safety Code Ann. § 481.116 (West & Supp.2000). After waiving his right to a jury trial, appellant was tried and found guilty of the lesser included state jail felony offense of possession of a controlled substance of less than one gram.
