Appeal from a judgment of the superior court for King county, Frater, J., entered September 28, 1918, upon the verdict of a jury rendered in favor of the defendant, by direction of the court, in an action for fraud.

In this action the appellant Harris seeks to recover from the respondent Saunders and the defendant Gerlinger the sum of $3,200, paid by *196him for shares of the capital stock of a corporation known as the Gerlinger Motor Car Company.

In his complaint, the appellant charges that the persons named conspired together to induce him to purchase the stock by falsely representing the business condition and the financial condition of the corporation named.
